Leave to care for a child up to one year old ( 育児休業 – ikuji kyugyou)

Working mothers will be able to apply for leave to care for their child until the child turns one year old.

The leave may be extended to one year and two months or up to 1 year and six months, subject to various conditions such as lack of daycare. In principle, the license is for one year.

To apply for the license

  • The mother must maintain her job at the company, that is, remain employed.
  • She must have worked in the same company for over a year with a good frequency of work.
  • From the date of the child’s first birthday, she must return to work or have the strong possibility of continuing to be employed at the same firm.

In the case of a temporary employee, whose employment contract is renewed periodically, she must also have at least one year of work in the same company. If the temporary contract expires in the middle of the license, she will still be entitled, as long as there is a clause on the renewal of the contractual agreement or there is a prospect that it will be renewed.

If the mother has applied for sankyu, she must wait until she finishes receiving this benefit (56 days postpartum) to receive ikuji kyugyou.

During this period of leave, she will receive around 67% of her salary until the 180th day of the leave and from the 181st day she will receive 50%, taking as a reference the average of the last six payments.

Exemption from Payment of Shakai Hoken: During the period in which she is away from work, receiving the benefit of leave to care for children under 1 year of age, she may be requesting exemption from payment of Shakai Hoken with the company.

To receive this benefit, the mother must ask the employer to submit the request to Hello Work. She must renew this request every two months. If the deadline for requesting the extension passes, the mother will lose her right to the benefit.
